Terms of Service

These terms govern your use of the AllergenAware Shopify app (the “Service”) provided by Arthur Williams, a UK sole trader trading as AllergenAware (“we”, “us”, “our”).

1. Acceptance

By installing, accessing, or using the Service, you agree to be bound by these terms. If you do not agree, do not install the Service.

2. About the Service

AllergenAware is a Shopify app that lets merchants tag products with allergen and dietary information, and that warns shoppers when products in their cart conflict with their saved dietary preferences.

The Service is a labelling and communication tool. It does not validate, verify, or certify the accuracy of product data entered by the merchant.

3. Eligibility

You must be an authorised operator of a Shopify store to install and use the Service. By installing, you confirm you have the authority to bind your business to these terms.

4. Pricing and billing

Subscription pricing is shown in the app and on the AllergenAware Shopify App Store listing. All payments are processed by Shopify under Shopify’s billing terms. You authorise Shopify to charge your store account for the plan you select.

We may change pricing on at least 14 days’ notice. Continued use of the Service after the change date constitutes acceptance of the new pricing.

5. Free tier

The Free tier is provided “as is” with no guarantee of continued availability. We may at any time, on reasonable notice, modify the features included in the Free tier or discontinue it entirely.

6. Acceptable use

You agree not to:

  • Use the Service to make medical, dietary, or allergen claims you cannot substantiate
  • Misrepresent product information in any way that could endanger shoppers
  • Reverse engineer, modify, or attempt to extract the source code of the Service
  • Use the Service to transmit malware or for any unlawful purpose
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Service

7. Merchant responsibility for product data

You are solely responsible for the accuracy of allergen, dietary, ingredients, and “may contain” information you enter into the Service. AllergenAware does not verify, validate, or guarantee the accuracy of merchant-entered product data.

The Service is a tool to help you communicate this information to your shoppers. It is not a substitute for compliance with applicable food labelling laws including (without limitation) the UK Food Information Regulations 2014 (“Natasha’s Law”), EU Regulation 1169/2011, and the US FASTER Act. You remain solely responsible for your regulatory compliance.

8. Intellectual property

The Service, including all software, designs, brand assets, and documentation, is owned by us. We grant you a non-exclusive, non-transferable, revocable licence to use the Service during the term of your subscription, solely for operating your Shopify store.

All product data you enter remains your property. You grant us a non-exclusive licence to process that data solely for the purpose of providing the Service.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding fitness for a particular purpose, accuracy, uninterrupted operation, or non-infringement.

We are not medical, dietary, or food-safety professionals. The Service is informational only and does not constitute medical or dietary advice.

10. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) £100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including (without limitation) lost profits, lost revenue, lost data, or business interruption.

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under English law.

11. Indemnity

You agree to indemnify and hold us harmless from any third-party claim, demand, or liability arising from (a) your use of the Service, (b) the product data you enter, (c) your breach of these terms, or (d) your breach of any applicable law.

12. Termination

You may uninstall the Service at any time from your Shopify admin. We may suspend or terminate your access if you breach these terms, fail to pay fees, or if we cease offering the Service.

On termination, we will delete your data in accordance with our Privacy Policy.

13. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to these terms

We may update these terms from time to time. Material changes will be flagged on the marketing site and notified to merchants via the app dashboard. Continued use of the Service after the change date constitutes acceptance.
